An auction of two horses trained by Rudy Rodriguez and owned by Ahmed Zayat’s family stable may not go ahead as planned following discussions of a negotiated agreement to satisfy the trainer’s claims of unpaid debts, according to both sides in the dispute.The auction of the two horses, Lezendary and Majid, was announced in a notice that ran in Friday’s edition of Daily Racing Form. The auction was scheduled for Nov. 1 at Belmont Park “by virtue of default in payments” by Zayat Stables, the owner of the two horses, according to the notice.Drew Mollica, the trainer’s attorney, said on Thursday morning, prior to acknowledging the discussions with the Zayats, that Rodriguez was owed a substantial sum in unpaid bills by the stable, a “debt that had been accumulating for years,” Mollica said. New York law allows caretakers of animals to auction off livestock for unpaid bills by owners, Mollica said, a tactic he has employed “a dozen or more times” in similar cases.On Thursday afternoon, Justin Zayat, who manages the family stable on behalf of his father, said that the two sides had reached an agreement on repayment of the debt. Mollica declined to comment on the agreement, but said that the two sides “were in touch.”Prior to that acknowledgment, Mollica said that Zayat Stables, the nom de course of Ahmed Zayat’s racing operation, had not paid bills related to the two horses for “up to a year.” He also claimed that the operation had previous debts to Rodriguez, and that he had been attempting to work out a settlement with the Zayats before electing to put the horses up for auction.“At some point, Rudy had no recourse left but this,” Mollica said on Thursday morning. “We are hopeful we can work something out, but for right now, he has no other choice.”Majid is a 3-year-old colt by Shackleford who has won four of his eight starts, including the Easy Goer Stakes at Belmont, with career earnings of $183,305. Lezendary, a 4-year-old filly by Zensational, has won two of 11 career starts and has earnings of $156,073. They are the only two horses owned by Zayat Stables that Rodriguez trains, Mollica said.Mollica said that the notice printed in Daily Racing Form on Friday was required by law under the statute that was being used to justify the auction.
