The Kentucky Court of Appeals has denied a motion by the trainer Bob Baffert seeking a stay of a 90-day suspension he has already begun serving, according to a ruling in the case. The ruling by the court is likely to put an end to any efforts by Baffert to seek a stay of the suspension, which he began serving on April 4 after several failed attempts to get the penalty stayed by both the Kentucky Horse Racing Commission and state courts. The suspension runs through July 2. Baffert has already removed all of the horses in his barn. In the ruling, the Court of Appeals upheld a late March ruling by Judge Thomas Wingate of the Franklin County District Court that the racing commission and its executive director had the power to deny the stay while Baffert sought an appeal of the penalty. The ruling by Wingate said that the state legislature had “clearly” given the commission the right to deny requests for stays, even if the KHRC rarely denied the requests in practice. Just prior to the suspension going into effect, Baffert had sought an emergency injunction from the Court of Appeals, but that request was also denied by a judge in the court’s appellate decision. That judge had pushed a final decision on Wingate’s order to the full three-judge Court of Appeals, which issued its decision on Friday. Baffert’s hearing before the racing commission on his appeal of the penalty is scheduled to start on July 28. It was initially scheduled to begin on Monday, but his attorneys requested more time to prepare for the appeal. The Kentucky Court of Appeals ruling is the latest to go against Baffert in his appeal of a betamethasone positive after Medina Spirit won last year’s Kentucky Derby. In addition to the 90-day suspension for Baffert, stewards ordered Medina Spirit disqualified from the race. Churchill Downs has banned Baffert through the 2023 Derby because of the Medina Spirit positive. Two months ago, Baffert sued Churchill in federal court seeking a preliminary injunction against the ban, but his attorneys filed a motion to withdraw the suit after he began his suspension. Last week, the court in that suit granted the motion to withdraw.
